1. Description of Services

LemonData is an AI API aggregation platform that provides unified access to 300+ artificial intelligence models from third-party providers, including but not limited to OpenAI, Anthropic, Google, DeepSeek, and others, through a single OpenAI-compatible API endpoint.

The Services may include, but are not limited to:

  • Chat completions API (including streaming responses)
  • Image generation and editing API
  • Video generation API
  • Audio synthesis and transcription API
  • Embeddings API

LemonData does not independently develop or train the underlying AI models and relies on upstream providers to fulfill API requests.

2. Account Registration and Security

2.1 Account Creation

To access the Services, you must create an account and provide accurate, current, and complete information.

2.2 User Responsibilities

You are solely responsible for:

  • Maintaining the confidentiality and security of your account credentials and API keys
  • All activities conducted under your account or API keys
  • Immediately notifying LemonData of any unauthorized use or security breach
  • Ensuring compliance with these Terms and the policies of upstream AI model providers

LemonData is not responsible for any loss or damage resulting from compromised credentials.

2.3 Age Requirement

You must be at least 18 years old or have the legal authority to enter into these Terms.

3. Billing and Payments

3.1 Prepaid Credit System

LemonData operates on a prepaid balance system. You must purchase credits before using the Services.

3.2 Pricing

Pricing varies by model and usage type and is displayed on the Website. Prices may change with reasonable notice.

3.3 Usage Deduction

Credits are deducted in real time based on token usage, API calls, or other applicable metrics.

3.4 No Expiration

Unused credits do not expire.

3.5 No Refund Policy

All purchases are final and non-refundable, except where required by applicable law.

3.6 No Refunds for Non-Persistent Service Issues

LemonData does not issue refunds for issues that do not constitute a sustained and complete unavailability of the Services.

Temporary interruptions, partial outages, degraded performance, upstream provider failures, model unavailability, rate limiting, maintenance periods, changes in model behavior, output quality, accuracy, or compliance-related restrictions do not qualify as service unavailability and do not constitute grounds for refunds.

4. Acceptable Use Policy

You agree not to use the Services to:

  • Violate any applicable laws or regulations
  • Generate illegal, harmful, or prohibited content
  • Circumvent rate limits, access controls, or security mechanisms
  • Resell, sublicense, or redistribute API access without written authorization
  • Impersonate any person or entity or misrepresent affiliations
  • Interfere with or disrupt the Services or infrastructure
  • Scrape, harvest, or collect data from the Website by automated means

LemonData reserves the right to suspend or terminate accounts for violations.

5. Service Availability and Regional Restrictions

5.1 Supported Regions

LemonData provides commercial API access only in approved countries and regions. This list may be updated periodically due to legal, regulatory, or operational requirements.

5.2 Unsupported Regions

Users in unsupported regions must not access the Services without written authorization.

5.3 Additional Restrictions

Certain Services or models may be subject to additional regional or compliance restrictions imposed by upstream providers or applicable law.

6. Intellectual Property

All Website content and Services are owned by LemonData and protected by applicable intellectual property laws.

You retain ownership of prompts and generated outputs. LemonData does not claim ownership of your content.

A limited, non-exclusive, non-transferable license is granted to use the Services in accordance with these Terms.

7. Privacy and Data Handling

Personal data is processed in accordance with the Privacy Policy.

API requests and responses are transmitted to upstream AI providers for fulfillment.

Usage logs may be retained for billing, security, debugging, and service improvement.

8. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

LemonData does not guarantee uninterrupted service, accuracy, availability, or fitness for any purpose.

AI-generated outputs may be inaccurate, biased, incomplete, or misleading.

9. Limitation of Liability

To the maximum extent permitted by law, LemonData shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Total liability shall not exceed the amount paid by you to LemonData in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless LemonData and its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of the Services or violation of these Terms.

11. Force Majeure

LemonData shall not be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, internet outages, or upstream provider failures.

12. Changes to Terms

LemonData may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
